This privacy policy describes how BAAM Consulting AB, org.nr 559104-7781, ("BAAM Wine" or "we") collects, uses and protects your personal data.

BAAM Wine operates BAAM  domaisn BAAMWine.com, BAAMWine.se and BAAMConsulting@com. These domains includes includes information about alcoholic beverage and to visit you have to be minimum 25 years old!

BAAM Wine is committed to protecting your personal information and if we ask you for personal information, you can be assured that such information will only be used in accordance with what is stated in this Privacy Policy. The Privacy Policy explains and clarifies your rights in relation to BAAM Wine regarding the processing of your personal data and how you can exercise your rights. It is important that you read and understand the privacy policy. If you do not agree to the Privacy Policy, you should not purchase our products or use our services. 

BAAM Wine acts as data controller for all BAAM Wine processing of your personal data. Purchases of our products are made directly from BAAM Consulting AB, which together with our transport supplier is responsible for the transport in Sweden until delivery to you as a customer. You as a customer can always reach us at the contact details listed below.

BAAM Wine complies with all applicable laws and regulations that exist to protect the privacy of individuals, including the Personal Data Act (1998:204) (PUL), the Electronic Communications Act (2003:389) and such other regulations that implement the EU Data Protection Directive 95/46/EC, the EU Directive on privacy and electronic communications 2002/58/EC and the EU General Data Protection Regulation 2016/679 (GDPR) and any amendments to,  additions to or regulations that replace such laws, ordinances, regulations and rules. We use appropriate and reasonable physical, technical and organizational security measures in relation to the amount and sensitivity of personal data.

Collection of personal data

In connection with registering as a member with us, when purchasing our products and services, contacting our customer service or through our website and if you participate in campaigns via e.g.  e-mail or social media, you may be asked to provide information about yourself that is considered to constitute personal data. This may include:

• name, social security number and contact information;

• shipping information, billing information, payment information and other information you provide for the purchase or delivery of a product or service;

• demographic information such as zip codes, elections and interests;

• other information relevant to customer surveys, advertisements and/or offers; or

• other user-generated information that you actively choose to share through our websites.

Supplementation by retrieving information from and interlinking with other private and public registers when e.g.  updating address information may take place. We may also collect personal data (social security number, name, e-mail and address) from Klarna in connection with the purchase of our products and services.

Legal basis

If you have ordered a product or service, you have entered into an agreement with BAAM Wine and we therefore process your personal data for the purpose of administering your order and to be able to deliver the product or service you have ordered. In addition to processing your personal data to complete the purchase of products or services, BAAM Wine may use your personal data for other purposes and on the basis of other legal bases, which are set out below.

• Consent: Based on the consent that can be given in connection with the purchase of products or services and when registering as a member with us, BAAM Wine compiles information about our customers and their buying habits and interests in order to profile the customers in different categories. The purpose is to be able to offer customers relevant and customized information and marketing from BAAM Wine through such profiling.

• Legitimate interest: In order for us to be able to provide, develop and improve our products and services and to increase our competitiveness, we also process your personal data in certain other cases, such as for direct marketing.

• Legal obligation: We save, but do not otherwise process, your personal data to fulfill our obligations under applicable alcohol, tax and accounting legislation.

Purpose of using personal data

Our purpose with processing personal data is to create and administer your member account, process and manage your orders for products and services, give you access to information and marketing, manage our relationship with you as a customer and customize, measure and improve our services, content and ads.

If you do not actively opt out, we may contact you, either by email, post, phone, text message or social media, to inform you about our products and services and to send you direct marketing, service updates and offers that we think you may enjoy.

We do not carry out any analysis of your customer behaviour (profiling) without your explicit consent. We do not sell or disclose your personal data to third parties for their marketing purposes without your explicit consent.

In order to fulfill the purposes above, your personal data will be processed by us, but may also be disclosed to and processed by our group companies, our authorized service providers and partners for processing on our behalf. Your personal data may also be disclosed to comply with legal obligations and may be disclosed to the police and other relevant authorities when permitted or required by law.

Storage of personal data

BAAM Wine takes all reasonable steps to ensure that your personal data is processed and stored securely. Your personal data is never stored longer than permitted by applicable law and to achieve the purposes stated above. Your personal data will be processed by us during the following time periods.

• Member or customer: If you have a subscription to BAAM Wine or if you have otherwise registered for any of BAAM Wine's digital services, your personal data will be saved until you cancel your subscription or unsubscribe from our services, but no later than three years after your last purchase or your last canceled subscription. However, this does not apply if we need to save your personal data longer due to any of the points below. 

• Performance of agreement: Personal data (name, social security number, address, telephone number, e-mail and payment and delivery information) provided in connection with ordering subscriptions and goods and services is saved as long as required for BAAM Wine to be able to fulfill the agreement with you. This includes, among other things, fulfilling delivery or warranty commitments.

• Consent: In cases where we process your personal data with the support of your consent, we only save your personal data as long as we have your consent to it. 

• Legitimate interest: We may process your personal data for direct marketing purposes for up to three years after the end of the customer relationship, unless you opt out of such direct marketing before then.

• Legal obligation: We save, but do not otherwise process, the personal data that forms the basis for declaration to the tax authorities in Denmark and Sweden due to applicable alcohol, tax and accounting legislation for seven years after the end of the customer relationship.

Transfer of personal data

Information about our customers is an important part of BAAM Wine's business and we do not sell the information to anyone else. We only transfer information as described in this Privacy Policy. We always exercise the utmost caution when transferring your personal data and your personal data is never passed on without our support in this privacy policy and that appropriate security measures are taken.

BAAM Wine may supplement your personal data with additional information by collecting information from other private and public registers, such as the Swedish National Personal Address Register (SPAR), BisnodeSverige AB and  Klarna AB. Through such coordination, enrichment and updating of your personal data may take place.

Your personal data may also be disclosed in order for BAAM Wine to comply with certain legal obligations and may be disclosed to the tax authorities and other relevant authorities in Denmark and Sweden respectively when permitted and required by law.

Such transfers as set out above may be made to companies within and outside the EU and EEA (i.e. all EU Member States plus Iceland, Norway and Liechtenstein). Regardless of whether we transfer your personal data to recipients within or outside the EU and EEA, we always take all reasonable steps, in order to ensure an adequate level of protection, for the transfer and processing of your personal data.

Your rights

You have the right to request information about what personal data we have registered about you and how it is used, after a written signed application addressed to us according to the contact details below. You can change your personal information at any time in your account settings online, if you have an account on one of our websites, or by contacting customer service as set out below. You also have the right to request that personal data about you be corrected if they are incorrect, incomplete or misleading by contacting customer service. To protect your privacy and your personal data, we may require you to identify yourself in connection with our assistance.

In accordance with applicable personal data legislation, you also have the right to request that your personal data be deleted or that the processing of your personal data be restricted. You also have the right, in certain cases, to object to the processing of your personal data and request that your personal data be transferred in electronic format.

You can file a complaint with the Swedish Data Protection Authority if you believe that BAAM Wine's processing of your personal data is not in accordance with applicable law.

Withdrawal of consent and termination of member account

In cases where we process your personal data because you have given your consent to it, e.g.  with regard to processing through analysis of customer behavior (profiling), you can withdraw your consent at any time by contacting customer service as below. Such withdrawal may be made in whole or in part. If you do not wish to receive marketing and promotional offers from us, you can contact customer service or, in the case of direct marketing by e-mail, unsubscribe from future mailings through a link in the relevant mailing. As for the latter, you will have the opportunity via the link to click through and manage all your subscriptions to newsletters from BAAM Wine.

At your request, we may terminate your Member Account and delete or anonymize your personal data as soon as possible. Deletion of data will take place in accordance with applicable law and this Privacy Policy. We may also close or disable accounts that are not being used.

What are cookies?

We use cookies mainly for the functionality of our services, to optimize the experience for a returning user, to help us improve our websites and our delivery of products and services, and to analyze where the visitor comes from and measure statistics. Through our cookies, we save information about, among other things, which pages on our website and in our online store you visited to facilitate navigation and manage visits between different pages. Cookies are also used to see if the user visits the site for the first time, to keep track of which items you have added to your shopping cart and to remember individual choices that the user makes.
